California Consumer Privacy Act Privacy Notice for California Residents

This Privacy Notice for California Residents supplements the information contained in the Hallmark Aviation Services, L.P. (“Hallmark”) privacy policy and applies solely to State of California, USA, residents. Hallmark provides this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”), which requires Hallmark to inform California consumers about the personal information it collects and their specific rights under the CCPA.

I. Notice of Collection

Hallmark and its U.S. subsidiaries collect and use personal information from individuals only to the extent necessary to provide services to our customers or for employment purposes. See also the section on General Information on Data Processing in our privacy policy. Hallmark does not sell individuals’ personal information.

Categories of Personal Information Collected

In order to provide services to our customers, Hallmark may collect identifiers, such as name, address, driver’s license number, internet protocol address, or other similar information; and commercial information, such as records of services provided.

For employment purposes, Hallmark may collect identifiers, such as name, address, and other similar information; other personal information, such as education and employment history; and professional or employment-related information.

Business or Commercial Purpose for Collection

We process your personal data for various purposes, including to provide and improve our services and for employment purposes, and based on several different legal bases that allow this processing. We also share your information with third parties, including service providers acting on our behalf, for such purposes. In addition, we may share your personal data among Hallmark subsidiaries and affiliates in order to fulfil our contract with you or your employer.

Generally, we obtain this information directly from you with regard to documents or information that you provide to Hallmark, and directly and indirectly from your activity on our website.

II. CCPA Rights

The CCPA provides California consumers with specific rights regarding their personal information. This section describes those rights and explains how a California consumer may exercise those rights.

Right to Access and Disclosure

You have the right to request that Hallmark disclose certain information to you about our collection and use of your personal information over the past 12 months, including:

1. The categories of personal information that we have collected about you;

2. The categories of sources from which this information is collected;

3. The business or commercial purpose for collecting this information;

4. The categories of third parties with whom we share this information; and

5. The specific pieces of personal information that we have collected about you.

Right to Delete

You have the right to request that Hallmark delete any of your personal information that we collected from you and retained, subject to certain exceptions.

We may deny your deletion request if, among other reasons, retaining the information is necessary for us or our service provider(s) to:

• Complete the transaction for which we collected the personal information, provide a service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you or your employer.

• Comply with a legal obligation.

• Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Opt-Out

California consumers have the right to opt-out of any “sale” of their personal information; however, as stated above, Hallmark does not sell any personal information.

Exercising your Rights

California residents may exercise the above rights by submitting a verifiable consumer request to Hallmark. A verifiable consumer request must (i) contain sufficient information to enable us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (ii) describe your request with sufficient detail so that we may properly understand, evaluate, and respond to it.

If you are submitting a request on behalf of a California resident, you will need to provide Proof of Identity (POI) and Proof of Address (POA) for the individual on whose behalf you are submitting the request and proof that you are authorized to act on their behalf. Without that information, we will not be able to process the request.

Response Timing and Format

We will confirm we received your request within the time period required by law. Hallmark aims to respond to a verifiable consumer request for access or deletion within 45 days of receiving that request. If we require more time, we will inform you of the reason and extension period in writing.

Right to Non-Discrimination

Hallmark will not discriminate against you for exercising any of your rights under the CCPA. Hallmark does not use the fact that you have exercised, or requested to exercise, any CCPA rights for any purpose other than facilitating a response to your request.
